Customer: My ex in-laws took my daughter to their friends house who happen to run a foster home left her there and Lied to me about how she was apprehended from her and gave me no other info. Nobody including herself tryed to contact me about the situation I called the RCMP he called cps and was told she had Not been apprehended and that I could go pick her up but not untill the next day and that I needed to call her. So I did call her and she was able to arrange for me to see her after I hadn't seen her for 5days nor had a clue where she even was .... Now same day I was told by RCMP when I called cps worker she said Craig (my ex) called that afternoon with aligations and so on.... What can I do legally and walk away from cps with my daughter today?
JA: The Lawyer can help you determine if that's legal. Where are you located? These laws vary by state.
Customer: I'm in Alberta canada
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.

Good morning – sorry to hear of this difficult situation. Are there any custody court orders in effect?

Customer
No
Customer
The point is, they left her somewhere without asking me to even go there at all for any reason, risked my 2yr old daughter of contracting covid19 then outright LIED to me by saying she had gotten Apprehended by CPS when in fact she did Not and so on spent the weekend terrified and wondering where she was. Is that not a form of kidnapping or unlawful confinement and mental abuse??

Sorry to hear of this. How did they get access to her in the first place?

Customer
I was packing our belongings because I am leaving my daughter's father. I'm not happy, he's not happy and it's no situation for a little girl to have to live in, so his mom offard to take her for a couple days, you know to make it 'easier' for me to do what needs

You could file a police report and report this to CPS. Perhaps do not leave your child with them in the future given what they did.

Customer
After a couple days I went to pick her up, I missed her. The mom almost didn't let me in the door with adamentcy of letting her stay cuz I wasn't done.. I reluctantly left her there. Well I did call RCMP and I'm meeting with cps now actually....after being told yesterday that my daughter was not apprehended and that I could go get her but not till today.... What's with that?

You'll have to clarify that with CPS. Very bizarre situation.

Customer
Ok.... But as far as the lying to me about the situation of my daughter, what can I legally do to make sure she can't mentally manipulate her or myself in the future?
Customer
This whole thing is discussing and I won't allow the mental abuse

You should get a court order to clearly specify the parenting arrangement so there is no confusion in the future.

Customer
Does that include a restraining order against the ex mother in law?
img

JosephE322, Expert

You can get a no-contact order between you and the ex-mother in law, but I'm assuming your ex will permit contact with their mother and the child.

img

JosephE322, Expert

Unless there is evidence of abuse by the ex mother in law and the child, then that's a different story.

img

JosephE322, Expert

Does that help answer your question today?

Customer
Sorta. So does it count if the evidence of abuse is her own living breathing son? I mean he's a narssasist, so that's proof she's capable of severe emotional abuse right?
img

JosephE322, Expert

To be clear, are you referring to getting an order that the mother in law not contact/visit your child?

img

JosephE322, Expert

If so, you would need to present evidence to the judge that the mother law is abusing the child, not that she is “capable of” being abusive. Anyone is “capable” of abuse. The question is whether she is actually abusing the child.
