Expert's Assistant chat
Customer: Hello, I have joint custody of my son with his father, me being the primary caregiver, he's with me over 90% of the time. I have an opportunity to move provinces where I'll have more job opportunities and I genuinely think my child can have a better life there than the small town we're currently in. I was wondering how I go about applying for relocation of my child in the court of Ontario.
JA: How much advance notice has been given?
Customer: No notice, it's just an idea for now.
JA: Has there been any mediation on this issue?
Customer: None
JA: Anything else you want the Lawyer to know before I connect you?
Customer: Just that his father never wanted him as a child, and that his father has been back and forth for a long time now on whether or not he wants to be in his childs life. His own girlfriend forces him to take our child for visits because he doesn't want to

Please note that the experts don’t text so there may be a bit of a delay. If you don’t answer back for a while I may not be online when you do but I will never desert you and will check back often. As well, as I am working from home it is possible that I will be interrupted but I will always return back as soon as I can.

I am sorry to hear of this difficult situation.

Given your facts do you think that your child's father will consent to you moving?

Customer
Okay I understand . I don't think the father will consent to me moving as he will want to have the opportunity to pop in and out of our sons life as he chooses.

Then what you will have to do is try and obtain a court order allowing you to move your son.

What you have to understand is that this is a very, very difficult challenge because in most cases it's very hard to show that it is in the best interest of your child to move your child away from his father.

So you'll have to have a compelling evidence that the move to the small town is better for your child even though you are taking him away from his father, and his home and his community except it.

For this reason your best next step would be to retain an experienced family lawyer who is handled many mobility rights cases.

What you can do to find a lawyer is one of the following things.

You can contact the Law Society and use their Lawyer Referral Service. You will be given the name of a lawyer and can consult with the lawyer and the first half hour will be free.

Here is a link to the site:

Or you can check on a site called lexpert. This is a legal directory of leading lawyers and law firms throughout Canada and is well-respected by the legal community.

Here's the link to their website:

Does that help as a starting point?
