Customer: I'm from the Tsilhqoti'n Territories and I had six of my Tsilhqoti'n children apprehended by the MCFD out of W.L without any trial for me. Now I was told that I am not qualified for the Human Right's tribunal order of $40,000 for my children that were basically stolen away from me. I was a single mother of six with no help from either father. Who can assist me with my case?
JA: What state are you in? It matters because laws vary by location.
Customer: British Columbia, Canada.
JA: What steps have you taken so far?
Customer: The interior of b.c. I have taken every step possible to get my children back. And nothing helped. My children came back home to me one by one on their own.
JA: Anything else you want the Lawyer to know before I connect you?
Customer: I still haven't had a fair shake in the Williams Lake lower court's to this day May 7, 2020.

Hi, thank you for contacting Just Answer. Counsel Creed here. I am not sure that I quite understand what you are asking about. You say that your kids HAVE returned to you?

Counsel Creed, Expert

Hi, again. Do you still need legal assistance?

Customer
All but one of my children, the youngest son. My five children ran away from MCFD foster care because three of them were being sexually assaulted. And my question is, the only way that the MCFD out of Williams Lake b.c. could remove all of my Tsilhqoti'n children from me off a Federal Indian Reservation was to label me abusive to my children with trumped up reports and charges. Which MCFD dropped after they removed my six children off reserve. In order for the MCFD to get at their Federal funding for each of my Tsilhqoti'n children who are all status Indian. We are not Canadian we are Tsilhqoti'n. Canada has assumed jurisdiction not sole jurisdiction over the Tsilhqoti'n Dené peoples'. I am being disqualified for the HRTC's $40,000 settlement against Canada, that Canada was forced to pay all indigenous families out across Canada, for taking our underfunded communities and their families apart instead of helping them. Every Tsilhqotin family/ parents were ALL labelled violent and abusive so that we would never receive any future compensation for this genocide that Canada has and continues to commit against the FNS Dené peoples'. That is what my grievance is. I was never brought to trial and my constitutional rights were egregiously violated year after year with no due process with the lower family courts in Williams Lake B.C. from 2006 - present day. I was earmarked to have my children removed from me as well due to my families political status out in the Tsilhqoti'n Territories. I am a human rights defender. That is the only reason my Tsilhqoti'n children were ripped from me. I was single at the time all six were taken from me.

So. if I understand you correctly, there are really TWO legal issues here:

1. your constitutional rights being "violated" way back n 2006; And

2. your youngest child still being in care.

I am not sure that ANYTHING can be done now, 14 YEARS later in relation to the case in Williams Lake. Whether it was a criminal or a civil matter, deadlines for an APPEAL of the lower court's decision are very short - typically 30 days or so.

As far as your son's case is concerned. the MCFD HAVE TO FOLLOW the proper procedure. Can you answer these questions: a) do they have a court application? b) what are they applying for? c) when is the next courtly date?

Customer
I was forced to sign a voluntary care agreement May 2011, and I had revoked it as soon as I heard my children were already being molested in care a few week's after removal, and I was completely ignored. My constitutional rights have and still are to this day, being trampled on by the W.L MCFD office and all parties pertaining to my case. The W.L. MCFD have a continuing order on my youngest l, again without due process of their plan. I was never given any court date. Even though I was showing up to court requesting further court dates. Again I was denied by the court's & MCFD. The MCFD & Cfs all have too much authority, as far as I'm concerned. They can put off any court date until families are unable to legally do anything about it.
I think all lawyer's here in Canada know that...what lawyer in Canada doesn't? in my opinion.
Customer
No court date as of May 2015. None. My case was shelved to buy time.

I am very sorry to her that. It does sound like you have been though a lot. If it is of ANY comfort to you, ALL my cases (child protection included) here in Toronto have also been "Shelved" due to this virus pandemic. I wonder, have you ever contacted the Office of the Ombusdperson of BC at the https://bcombudsperson.ca/. Perhaps they can help you? Maybe you even have a case for the Human Rights Tribunal? You can find a lot about them here: http://www.bchrt.bc.ca/law-library/guides-info-sheets/guides/human-rights.htm

Customer
Thank you for your kind sentiment. I've done everything humanly possible in order to recover my children back and to clear me of any wrong doing. When I say shelved, I mean from day one. Because, my case has been placed on the permanent back burner by the MCFD. So that my six Tsilhqoti'n children's $300,000 per year income, by the federal gov't, can generate fluid income and steady gov't jobs, and only in
b.c.'s best interest and not my Tsilhqoti'n children's or family's best interest. So that the gov't can pay b.c's monster financial debts to China, until they all aged out and not to mention, as a high profiled cases. Also,my case has nothing to do with this covid 19 live exercise. I've never swayed from the truth. With MCFD it's "guilty until proven innocent" game they play, in order to get that Federal funding that the MCFD unregistered bsw workers, have all been highly trained and plan this all out before our family's even hit their financial radars.. Their moto is "Plan on." I've spoken with all available resources out there you can possibly think of.
It's a stacked game. And all Indigenous mother's across Canada are always on the losing end here in Canada regardless. Our Indigenous children are the "stolen generation" so that non indigenous bsw workers families can pay their rent & put food on the table for their children. So no there is no one that have stepped forward to assist me & my Tsilhqoti'n children even though that is their title. Like I said it's all a stacked game.

Customer
No thanks.

Would you then mind rating me on your page, since that is the only way that I will get paid? You can do that by clicking on the 3, 4, or 5 stars in the top right-hand corner. Thank you.

Counsel Creed, Expert

I note that you have not yet rated me. Perhaps you can draw your mind to it now?

img

Counsel Creed, Expert

I am sorry but I do not understand why you rated me negatively! You seemed very appreciative of my advice AND also stated that you had no further questions for me! Would you consider giving me three stars instead of two, because I will not get paid if your rating stays as it is now? Thank you kindly.
