I am sorry to hear that it sounds like you are in a difficult situation.

What province are you in please?

Have you separated from the other parent already?

Customer
I'm in Ontario and yes over 2 months ago

Legal Ease, Expert

It is very difficult to navigate our family law system. Speaking frankly even family lawyer retain family lawyers when there is a separation.

Custody and support are the most vital of issues of course. So there are lots of resources you should consider before deciding to self-represent. It honestly has to be a very, very last resort.

You should see if you are eligible for legal aid:

https://www.legalaid.on.ca/lawyers-legal-professionals/legal-aid-online/getting-started-with-legal-aid-online/

And you can get some free help here:

https://www.attorneygeneral.jus.gov.on.ca/english/family/infoctr.php

Also, you can contact the Law Society and use their Lawyer Referral Service. You will be given the name of a lawyer and can consult with the lawyer and the first half hour will be free.

The number is:

1-***-***-**** or(###) ###-####(within the GTA)

You need to sue the other parent for custody and child support. It is a major lawsuit.

Here is what you need if you are going to do this on your own:

https://www.attorneygeneral.jus.gov.on.ca/english/family/guides/Parenting_Affidavit_Self-Help_Guide-EN.html

Does that help as a starting point?

Please feel free to post back with any follow-up questions you may have. If you don't have any then I hope I have earned a 5 star rating but if you don't feel that I have please don't hesitate to reply back and let me know what more I can do to assist you. Finally, please know that even after you rate me I will be here for you and you can ask follow-up questions if you think of them later on at no further charge of course.

I just didn't know if I should file paper work before retaining a lawyer if I just go with someone from the start

You should definitely see a lawyer first. The lawyer has to do the forms. They know how.

The forms are vital.

Customer
Ok so u won't be able to yell me which forms to fill out ?

Legal Ease, Expert

I sent you a guide that tells you what to do. It gives you all the forms just as you asked.

But I am a retired senior family lawyer in Toronto and I am urging you to get legal advice first.

The link is in the body of my answer but here it is again:

Customer
Ok thanks yes I have consulted a family lawyer I just want to get things rolling I need to make sure my kids are safe

Of course.

So spend some time reading that document. It explains the law and the process and provides the forms. I am just hoping you don't go ahead on your own. The consequences are just so vital of course.

Ask a lawyer and get your legal questions answered.
