Expert's Assistant chat
Customer: When sending a contract cancellation within a timeline if the business is closed during business hours will it count if an attempted delivery was made and the business was closed and you have a record of FeDex attempting delivery?
JA: Some laws are different depending where you are, so could you clarify what state you're in?
Customer: I am in Utah, the business the contract cancellation was sent via FedEx is in Kansas.
JA: Have you tried anything so far that has helped or clarified the issue?
Customer: I have made 5 phone calls to FedEx between Noon and a few minutes ago asking that the driver go to the FedEx holding station in Walgreens to take the package to the business. I have offered and will pay a $100 bonus via Venmo for once I get a notification prior to Midnight tonight it was delivered at the address listed in the cancellation clause. Along with I called the Walgreen and spoke with an employee there to help me understand the situation in regards ***** ***** for the FedEx station in their store.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: The contract is to cancel a Vacation Membership with Global Connection, Inc.

Dan Dufresne, Expert

I look forward to assisting you.  In which state do you reside?

Customer
This information was already submitted in my chatbox, here we go I live in Utah the travel vacation membership where I FedEx the cancelation I was supposed to be delivered today and they were not open there in Kansas.Does the $65 I just paid ( When it was presented that I was going to be paying $5 to ask text questions) include a phone call or do I have to pay another $59 for a phone call? I'd rather have a conversation than send a gazillion text messages.
Thank you
Customer
Sounds like you may not have got my initial question so the circumstances are I've also been on the phone with fedex from noon to little after 5 to day spoken with 5 different representatives and have offered to pay/Venmo a fedex driver to take the package that is now being held at a Walgreens fedex holding Box or shelf a $100 bonus to take the package to the business it's supposed to be delivered there by midnight. If I have a tracking record showing that delivery was attempted but they were closed with that count without suffice within the 3 day window?
Customer

Thanks for the clarification.  The language of the contract is paramount.  Indeed, "Cancellation must be RECEIVED on or before 5 days" is different from "Cancellation within 5 days."

Yes -- I'm working in real time so thanks for your patience in advance.

Customer
I'm just going roll with you in this via text versus the phone call cause it looks like I have to pay another 60 bucks when I thought I was only going to pay 5 to ask a question.

Okay -- the notice states the cancellation must be MAILED or DELIVERED no later than 12/30/22.  Therefore, a postmarked letter dated 12/30/22 should comply with the termination requirements.  Is there anything else I can clear up for you?

Customer
Have records from FedEx that their business was closed or unavailable. Some additional insight.. when reviewing I the information for the FedEx delivery label it prefilled to Leawood, KS the city where the Walgreens FeDex hold station is and I said no no that's wrong and I had him switch to Kansas City that city listed in the contract cancelation info.

Customer
It not a post mark.. it is FedEx. Does FedEx count as being mailed?
Customer
Sent an image of the tracking details via text.
