I learned at the time of the accident from another employee that they were carpooling together to go to one of the school sites. The driver of the car was not the owner of the car. The owner of the car was on the passenger side. She had just purchased the car and to my knowledge (learned from another employee), didn't have registration or insurance on the car yet. Another employee in the back seat was riding with them.

The car is not a company car. Upon hiring, we explain that they will start work at our office site and then go to facilitate programs for youth at a school. We then ask if they have reliable transportation because it is necessary for the job they are applying for.

While I always preach an abundance of caution in advance for companies in which their employees drive personal vehicles for work activities (I just had this conversation with my father the other week…) the answer is that, in practicality, a business does not have a terrible amount of exposure should an employee get into an accident while working.  Really, the greatest exposure comes when a company sends someone to drive for the company and knows or should have known as to a dangerous driving record.

Here, I don’t see any exposure for your company.  The biggest reason why is because a 3rd party is clearly at fault for the accident.  Your employees should deal with that driver’s Insurance and/or their own personal auto insurance.  I know the owner didn’t have it yet - but if she has a policy on older vehicles, there should be a newly acquired vehicle provision to cover the new car - depending on the time frame here.  The other two persons may have benefits on their own auto policies that could play a role here as well.  Regardless - the ultimate and main target is the at fault driver.

Again, to summarize, I don’t see any exposure for your company here under these facts.
