Customer: Hi. I am on Strata Committee and own and live in a unit of 20. A few owners have neglected their front wooden windows that have rotted now and need total replacing. Built 1986. Its strata responsible area BUT in Schedule 3 in Strata Act it says owners all need to be responsible for upkeep. Does the Strata if neglected have to pay to replace these windows? Thanks Lyn

Customer: It came to Presiding officer attention a year ago. As a committee looking at it the last 6 months.

Customer: The committee got quotes on all front windows to replace, repair, upkeep and asked for levy to pay however has to wait for AGM (maybe June)for all to discuss and decide. As part of committee I wanted to explore this legal side of neglect too see if Strata totally $responsible or can be put back on owner due to neglect and schedule 3 2 builders when quoting said windows would not be in that state if they had been looked after.

Thank you for your follow-up. Regarding the unit owners, the strata committee, can pass a resolution that all unit owners have to be responsible for the cost of the repairs or a special levy can be issued against the unit owners.

I was under the impression that the Strata is responsible for Strata repairs. we charge about $311 / quarter to cover Administration and $75 /quarter to cover extra costs. As u can imagine this isn't enough.

Is there a special repairs that need to be done strata can issue a special levy for that process. It also depends on the sinking fund that exist at the present time to fix things.
