Customer: The Wyong S
JA: What state is this in? It matters because laws vary by location.
Customer: nsw central coast the wyong shire council apparantly made 13 house historical, with no notification and put into the local library over xmas new year holidays. we were in nz my husband was a builder and we would have known if we received a letter. LEP13 was listed 1st Novermber 2019. My neighbour bought in 2016 with no knowledge it was under this order, nor did other neighbours that I talked to.It has destroyed our health and wealth. At 72 he had to renovate the broken down cottage, his heart blew out to an anaraism, a heart attack and stroke, he has no speech and unable to move right hand. Brian put in plans for the back, a small 2 bedroom open plan cottage, which has been in Council for 5 months, the Heritage Architect doesnt want cars parked beside the vista of the heritage cottage. The numbers only told to us by Real Estate agent, 51 to*****
JA: What steps have you taken so far?
Customer: I went to Steven Cutler Solicitor,he apparently was deputy Mayor at one stage, Conflict of interest, wrote nothing down had a women from Newcastle came back with goobleygooch. Wrote to local MP David Mehan, Wrote to David Crouch MP, letter passed to the Hon Rob Stokes, pass the parcel1Father Daniel Donovan at no 31 was the executor of the family property been in the family 100 years tried to talk to council in 2021. We are at***** Brian renovated it in 1977,The walls are half two ply and astestos, the road is now a busy main road, we have no insulation. Our facade is not the original, houses down the street have had the aspestos pulled out, outside pulled off and the front cut in, We wer e told we would be fined if we took asbestos out by solicitor. At 75 I am now a full time carer for my husband, we have been in lockdown since we came from NZ, all our friends are there, Brian was a founding member of Mana Kayaking Racing Club working 40 hours a week coaching, fixing equipment, the girls called him Poppa. We were part of young familys, In 2016 Porirua City threw a 50years birthday, 500 sit down 3 course meal. entertainment and dancing. Brian was one of the 50 chosen for services to the community. Awards for Kayaking, Curtis Imrie came 5th in Tokyio Olympics, Awards for 50 years Lifesaving. He represented the Central Coast 6 times in Lifesaving, NSW titles, Rugby Union, rugby League. This house is not suitable for 2022 living, it is our history and heritage my grandmother and I have owned it for 70 years. We were over every 2 years fixing stuff staying with relatives at***** checking at the Estate Agent.I paid the rates from NZ. The agent sent rental everymonth. I would take 3 to 4 weeks. Never heard anything.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I have gathered as I can, the council put out a 10.7 amendment in 2020, to cover tracks. They are also trying to make it into a Precinct with The Entrance Pub a commercial brick building. These houses are asbestos, fibro and tin shacks that was originally R3 with Council. How long to you throw money at broken down old places? I am sorry, I'm a bit all over the place, since 2018 we are living our worst nightmare. Our tenant punched holes in the asbestos, painted the windows shut. A tenant hung herself on the false beams, in my husbands culture, its bad luck and the house should be pulled down, we had two bodies turn up in the harbour a couple of weeks apart, nobody was able to train for 3 weeks, they are culturally sensitive. Thank you for your time

Hi! My name is***** a solicitor in Australia, and I’m happy to help you.

You can seek a resolution and claim compensation.

Issue a formal complaint in writing. Request a review on the matter.

Include a time limit of 7 to 14 days subject to your requirements for a reply.

Make sure you enclose all evidence with the correspondence.

When you draft this correspondence, use a number for each point.

Where no response is received and reviewed the conditions carefully on any agreement and is still not satisfied with the situation, you can then raise a claim in the Tribunal or Court.

I suggest you file a claim as soon as possible if the matter does not resolve.
