Expert's Assistant chat
Customer: Can I take action against a newspaper or the specific journalist who reported the death of my brother, with his name and photo, before the family were notified of his death? I had to find out my brother died over the internet, then come and tell my mum her first born child was killed, and a bunch of strangers online knew before she did
JA: The Lawyer can help you determine if you have a case. Where are you located? These laws vary by state.
Customer: I am located in Victoria, the death and journalist are located in sydney
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: That is it, thank you

You Could raise a claim of defamation in the Supreme Court.

Customer
Hi, thank you so much for getting back to me at such an early hour. I thought defamation had to have untrue statements? The name and picture published was accurate, but they published this information before our parents had been notified of his death

If you can prove there was half of conduct, you could potentially raise a claim. Would you should do is take a snapshot of what's on the Internet, then take a few local lawyer and they will investigate the matter.

Customer
I have screenshots, but I believe he has found a technicality that allows him to traumatise me and my family with no consequences for his behaviour. His partner's family had been notified, so he was able to be named in articles. I believe this journalist has gone to the partner's Facebook page, seen who he was in a relationship with, gone to my brother's page and taken his photo and name from Facebook. I don't know if that breaks any laws or journalist ethics given he wouldn't have been given actual confirmation from police or whoever gives that information that it was 100% confirmed my brother.

What you should do is immediately run a case in the court. Reach out to your local lawyer and they will help you with that process.

I hope this message finds you are well.

Just recapping your circumstance, if you consider there was some form of defamation that has occurred which was incorrectly published by the paper and produced by the journalist, you can raise a claim accordingly. The claim can be brought into the Supreme Court.
