Customer: We had a flight cancelled back in March 2020 due to flight route being cancelled from Covid. I have filled in all the relevant details with Air Asia & even been asked to provide bank account details but still waiting for refund or confirmation. Can I do anything to escalate the refund or even be certain that they will provide our money back.
JA: What state/territory are you in? It matters because laws vary by location.
Customer: my case status has shown in progress for months. I’m in Qld. Air Asia based in Malaysia. The latest email from them claim that they won’t refund any money until their long haul routes are reinstated
JA: Are there any relevant dates or timelines to consider with this?
Customer: It’s been two years. They cancelled on us, we didn’t cancel or postpone
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I don’t know what else would be relevant. Just want to know if they can keep putting us off since they have our money for a service not performed. What costs are evolved to us to follow this route?

Hi! My name is***** a solicitor in Australia, and I’m happy to help you.

If the agency is not acting appropriately with refunds you may raise a misleading conduct claim.

The Australian consumer law will protect you under the consumer guarantees that apply to all Australians.

May I suggest that you issue a formal complaint in writing to the other party, seeking an assessment/review on the matter and that you require a response within 7 to 14 days subject to your requirements!

Where no response is received, you can then raise a claim in the Tribunal.

Customer
Okay, thank you. The company in question have made it hard to communicate, but I have kept all emails received from them. To raise a claim in the tribunal, do I just come back to this portal, or approach Qld consumer Affairs?
