If Someone needs a representative to attend the court to apply for a court injunction for police to retrieve children

Expert's Assistant chat
Customer: If Someone needs a representative to attend the court to apply for a court injunction for police to retrieve children from their grandparents and fathers house, would someone be able to attend the court and assist with getting the injunction?
JA: What steps has the representative taken? Have they filed any papers in family court?
Customer: No steps yet. They need to get a lawyer now, and go to court tomorrow for the injunction but they would like someone to support them.
JA: Family law varies by state. What state are they in?
Customer: No paperwork filled out.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I’m talking on behalf of my daughter. The grandparents have very minimal contact with the children and father has had nil contact for over 6 years. the children went to the grandparents house for a couple weeks at Christmas time and are refusing to give them back.

Hi! You’re speaking with John Melis, a solicitor in Australia.

Where there is a matter of children involved, and there are court orders already stamped, you can seek your assistance of the police to enforce those orders for the return of the children. However, if there are no court orders in place and the grandparents are refusing to return the children, you should commence an urgent action in the family court.

You can either run your own case, or engage a local lawyer to help you filing the application in the court.

Thanks, ***** ***** the childrens father live with his parents, I was informed by police today that they can’t retrieve the children because the father lives there and he can keep the kids as long as he wants.

If the children father lives with his parents, then what you will need to do is follow the practice direction procedures for parenting. That includes having to do mediation first. The mediation fails you can then obtain a section 60 I certificate, then commence proceedings in the court.Have I answered your question? If any part of my response is unclear, please let me know. It’s my goal to deliver excellent service, so please let me know if there is anything more I can do. Thank you for using our site.

How long will it take to get a court injunction once I go to the court?

John Melis, Expert

The process, just depends on how long it takes the documents to be prepared and then fold into the court. That depends on the lawyer you engage.
