Customer: Hello, my family lawyer has suggested that I apply for an IVO against my daughters father. She did advise to do online but should I engage a specific type a lawyer to help with this? Also which type of intervention order do I apply for? He is my daughters father but not my ex.
JA: Was a protective order issued? What were the basic terms?
Customer: Not as yet. We have no court orders in place anymore. Have recently done mediation but will need to go to court as well.
JA: Is there ongoing abuse or harassment? Were the police called?
Customer: He and his wife continually post defamatory posts about me publicly on their social media and also continue to speak horribly about me to my daughter. I have confronted him about it and he had admitted it in writing but said he plans to keep doing it. No police have been involved as yet.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: He has been in and out of our daughters life as he pleases for her whole life (8 years). He took off with her when she was 5 months old and I recieved a recovery order. Since then he has been like that. I also have plenty of evidence that I have encouraged their relationship and he chooses not to respond to my attempts. I think that is about it.

Hi! My name is***** a solicitor in Australia, and I’m happy to help you.

Based on the information you have provided, you should apply for a restraining order for protection.

Customer
Thank you, ***** ***** went on the magistrates website, I could only find the family violence intervention. I am just confused if that is the one I should apply for? He isn't my ex, we were never in a relationship. He is my daughters father but it was a one night stand.

You can make an application to the court. Use the family violence intervention order form. Just download the form as it has a few steps that can guide you along the way.
Customer
When it is put through and goes before a magistrate, should I have a lawyer?

You can run your own case to explain to the court. Alternatively, you may be able to reach out to legal aid to assist you.
