Expert's Assistant chat
Customer: Yesterday Mum and I evicted a Tennant from our granny flat and he lunged at me twice and once at my mum with a weapon in his hand. Multiple death threats to me, assaulting his ex girlfriend and the police were called not only by me but also from the neighbours on 5 seperate occasions. The police were here in 5 minutes arrested him and took him to castle hill police station and released him with absolutely no charges and even brought him back to my place and I told the cops I don't want him on the property and they refused to remove him and told me to calm down because I'm making things worse for myself. I've since found out he's a crown witness because he's a snitch they refused to charge him with any offence and no avo. The police blamed mum and myself because our stories weren't the same. This guy is with the Fink's
criminal outlaw motorcycle gang and I fear for my safety and mums safety and property. Please help us.

Hi! My name is***** a solicitor in Australia, and I’m happy to help you.

You will be able to pursue assault charges against the tenant. Additionally could also raise a claim for compensation on the civil basis in the New South Wales civil administrative tribunal but I would recommend you take that matter into the district court.

You may lodge a claim in court.

The court’s website has a forms section to download the documents to commence the claim against that other party.

There are practice notes on the court’s website. There are various resources also, which you could utilise to aid you in completing the claim form.

Once you have submitted the claim form to the court, you must serve the other party with the documents.

You will receive email communications from the court, and you need to review these communications carefully, as they give you instructions on what to do next.

Does this help with your question today?

If you want to raise a case against the police, you can run your matter in the Magistrate's Court.
Customer
Why would they not charge him with assault at least or an AVO
