Customer: Queensland
JA: What steps have you taken so far?
Customer: We have submitted a claim and their assesor has been out. We don't udnerstand the PDS enough to know what we should be claiming? The assessor told me today they won't claim for the repair and any resultant damage, the will only cover replacement of the water damaged cabintery We have had a leaking hot water pipe, it's flooded the kitchen cabinetry.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.

John Melis, Expert

Hi! My name is***** a solicitor in Australia, and I’m happy to help you.

Regarding your claim under the insurance policy, can you tell me what you want to claim. You've explained you've had a leaking hot water pipe and its cause damage to your floor. If the pipe leak is there as a result of a common pipe in the property, then the strata should be covering the damage to your property.

Does this help with your question today?

Customer
The pipe is not common. We are trying to determine liability

What you need to do is obtain a copy of the plan of subdivision, then you will be able to work out who is liable for that pipe.

Customer
We are liable for the pipe we know that already- it’s about repatriation after pipe repair and also fixing damaged cabinets

There is a possibility that the insurance company should cover those aspects but I will come down to the terms and conditions of the policy that has been entered into by the strata management.

Customer
Thanks
