Hi! My name is***** a solicitor in Australia, and I’m happy to help you.

I suggest you issue written correspondence to the company explaining the problem and request a response within 72 hours.

Once a company receives a written response, it will act quickly.

Many people around Australia are having the same issue.

You can issue the complaint on the company's website. You may also send correspondence by Express Post to the head office.

If no reply is received, then commence proceedings in the local tribunal.

You can sue for compensation.

You do not need a lawyer to apply with the tribunal, and you can run the case yourself.

Does this help with your question today?

Customer
That’s helpful, thank you! I have already raised a number of complaints with the company but the issue still remains.

John before you go
Customer
I’ve never had to go through this whole process of running a case in a local tribunal. Can you elaborate on how that process unfolds?
Customer
Is this chat still open?

John Melis, Expert

When you go to the tribunal, you need to file an application which is for putting your case forward. If you are the respondent, you need to respond to the application has been raised against you. You should put all your evidence in a chronological order. That will help you prepare your case and present your case before the tribunal.
Customer
Okay, will there be any costs involved in all of this?
img

John Melis, Expert

If you are the applicant you just pay the application fee for the tribunal which is a couple hundred dollars. You’re handling this matter very well.If there is anything else, big or small, that I can help you with today, please let me know?Does this help with your question today?
Customer
Sure, is compensation all that I can sue for?
img

John Melis, Expert

Compensation is the main remedy in your particular case.
Customer
What would be compensation be in this case?
img

John Melis, Expert

Your compensation is based on the amount of losses you have incurred. You have to work out what loss you have suffered in order to determine the dollar amount.
Customer
Okay, what would be the loss in this situation?
Customer
The supplier of gas, water and electricity has been overcharging my account for the current property I live in. I moved into this unit on the 18th of December 2020 but my first bill is back-dated to August 2020, with which I am being charged for a total of 256 days. I have made complaints multiple times. The company responded with a proposal to move forward the move-in date for the account by a few months. This still did not fix the billing issue. They advised that there was a faulty meter for the Fair Air system which has since been replaced, however they still have not properly back-dated each bill I receiveThey continue to send further bills with the balance carried forward, still overcharging the account.

You can claim the amount you think is reasonable.
