Customer: We have been stuck in the northern beaches in lockdown for 3 months now and are wanting to return home to our home in qld. My mother is 79 and has bowel cancer and we live on the same property. Each time we apply to return home we are refused entry because we are not essential workers. We would be great full for any advice. Thank you
JA: Have you talked to a Queensland lawyer about this?
Customer: no not yet what type of lawyer would we search for
JA: The Lawyer will be able to walk you through that. What steps have you taken so far?
Customer: we were working in Sydney when the lockdown happened. Since lockdown we have been living in our caravan following the local directives but now my mother is in distress we are really worried about her. My daughter was living in our house and keeping an eye on my mother but she has now moved into her own home. We work between NSW and Qld. Our plan was to go home when my daughter moved into her own home. Now my mother is stressed as we can’t come home and we are concerned if she were to have a fall there would be no one around on a daily basis to check on her. Now with her bowel cancer issues we are desperate to get home to support her. What kind of lawyer would I contact in qld
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: we are more than happy to provide a negative covid test and home quarantine but flying in to qld to quarantine is not viable as we have to vehicles and a caravan and stock with us.

Hello, I’m John Melis, a solicitor in Australia, and I’ll be helping you with your question today.
Have you applied for the exemption to travel to Sydney? And have you received any rejections from the government?

Customer
Hi we are residents of Qld and have been in lockdown in NSW for 3 months. We were working here and are wanting to return home as my 79 year old mother is having health issues. She lives on our property. While we were away working we had our daughter living in our home to keep an eye on my mother. She has now moved to her own house and we just want to get home. We can’t fly in and quarantine as we have two vehicles and a caravan. We are fine to provide a negative per test and have complied with all lockdown orders but I am now really concerned about my elderly mother. It’s very difficult to have her in tears several times a day. We have applied for a border pass and been refused. Is there anything else we can do. I have be researching a bit on human rights and rights to move freely in our country but obviously a lawyer will know where we stand legally.
Thank you

What you can do in this particular circumstance is obtain represent medical evidence with respect to your 79-year-old mother, and then apply for an exemption on urgent basis with supporting medical evidence. That will help you get back to Sydney.
