Expert's Assistant chat
Customer: I am a tenant living in Southport. There is a safety issue the apartment as a elderly lady has died and her drug-addicted daughter has moved in, I have contacted policed and attempted to contact Body Corporate for the set of units. The ownere I have spoken to do not have any contacts, the Real Estate have no contacts and nobody knows who the Body Corporate is. Also due to safety issues - I am a single mother with a child, I am considering moving out and breaking my lease. What are my legal rights.
JA: Because laws vary from place to place, can you tell me what state the property is in?
Customer: Qld
JA: What are the terms of the lease? Any issues related to maintenance or upkeep?
Customer: The external drain pipe outside of the unit is leaking and has caused damage. The real estate cannot find who Body Corporate is and the owner does not seem to have any contacts. So there is damage to the ceiling which cannot be repaired because it is a body corporate issue.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: No

The unit involved are full of drug users and I am a single mum with a child, living in the unit next door. Meditation - really? I was looking at grounds for breaking my lease or finding ways to track down the Body Corporate for the Building so strategies can take place. I don't think we are on the same page?
Customer
No I only some basic advice of my options legally regarding breaking the lease, the legal requirement for Body Corporate to take reasonable action - I am not looking at mediating with members in a drug house.

You can break your lease on the basis of safety issue in accordance with the lease terms.
Customer
OK thanks - what about the legal requirements of Body Corporate- and the fact they are not contactable.
