Expert's Assistant chat
Customer: TASMANIA]. I accumulate 2 demerit points by speeding on the LAST DAY of Good Behaviour Period(POGB), i elect to court, will it be consider
JA: Have you talked to a Tasmania lawyer about this?
Customer: i am looking for advice, i am appearing on court myself
JA: What steps have you taken so far?
Customer: I got letter of suspension as i accumulated 12 points, i choose to take POGB which was ending on 18th Nov 2020. Unlucky me, same day police caught me on speed gun, doing 94 on 80 zone and send infringment notice with 2 demerit point. If i pay it will be suspended for 6 month. so i choose to take this matter to court and plea Guilty. i have court date 30th April, next Friday.
I have loose most of the point on speeding (doing 10-14 over limit) so i think court will take it seriously.
I found ATOP (Australian Traffic offender Program) course, online in four days, $240. is it worth doing this course so i can impress to magistrate and not to suspend/less suspension / reduce penalty
Does Magistrate can reduce penalty if i did this course and write good Plea in mitigation mentioning i need license to keep my work(i work as disability support worker and license is essential for work, i need to transport client).
or can Magistrate allow for one year more POGB, or Magistrate is unable to change the punishment
if Magistrate decide for 6 month suspension as normal, does it start form the same day or do have time or can i request to start a month later
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I am confused should i do ATOP course or not, is it relevant
JA: What confuses you?
Customer: can Magistrate change the penalty or it will be normal as 6 month suspension

Hi! My name is***** a solicitor in Australia, and I’m happy to help you.

You may apply for a diversion program to the court directly.

The magistrate or judicial officer will adjourn the case while a defendant participates in the diversion program.

This program targets offenders who have pleaded guilty or been found guilty of traffic offences in the local court.

The Traffic Offender Intervention Program is a community-based road safety education program. It provides offenders with the information and skills necessary to develop positive attitudes towards driving, become safer drivers, and maintain their licence.

Have I answered your question? If any part of my response is unclear, please let me know. It’s my goal to deliver excellent service, so please let me know if there is anything more I can do. Thank you for using our site.
