Customer: I need help regarding an inefficient strata manager. The painting and repair work to our unit at Hallet cove has been ongoing for nearly three years and is still not finished. this man avoids giving time lines, makes excuses and gives empty promises. The balcony of our unit has deteriorated so much with wood rot, it has become dangerous for our tenant to walk on. The strata manager says the work was put off because the wood rot was worse than expected. this is only the tip of the iceberg. Where do I stand in making a formal complaint about his incompetency and getting legal representation?
JA: What state are you in? It matters because laws vary by location.
Customer: South Ausralia
JA: What steps have you taken so far?
Customer: Endless emails back and forth from my property manager who passes on responses to me. His responses are very
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: The issue is very deep with him not being bothered about legal threats. He just doesn't seem to care. The other unit owners are either old or do not understand so agree with all he says at AGM's. these meetings I can never attend as he holds them when I'm at work. The unit/meeting is an hour and half away.

John Melis, Expert

Hello, I’m John Melis, a solicitor in Australia, and I’ll be helping you with your question today.

I am sorry to hear about the situation you're having with the inefficient strata manager failing to paint and repair the work in your unit in a timely and efficient manner.

I suggest that you issue written correspondence to the strata manager explaining your disappointment on how they are approaching the matter. If they do not rectify your unit in a timely way after that correspondence if you have not sent it already, then your next step is to raise proceedings in the local tribunal. SACAT.

The State Tribunal is perfect for mediating disputes.

The document you file in the tribunal is the points of claim. You can download this from the tribunal website.

Draft the complaint in numbered order detailing the issue. I suggest that you also say what action you have taken to try and rectify the matter.

You can run your case yourself.

There are help menus on the tribunal website that you can use to assist you with the application and process.

When you lodge your application, you will receive an email from the tribunal with the next steps to follow.

Have I answered your question? If any part of my response is unclear, please let me know. It’s my goal to deliver excellent service, so please let me know if there is anything more I can do. Thank you for using our site.

I and my property manager have had endless back and forth emails to the Strata Manager who eventually, in his own laid back time answers with an empty promise/time line. I have tried ringing him but he is always 'out at a meeting' My property manager does not know what else to do. The balcony of my unit has deteriorated so badly, it is not full of wood rot that it is dangerous for my tenant to use. This so called work has been ongoing for nearly three years. He has promised to let me know when it is finished and supply photos but I never hear from him.

As your balcony is a wood and rotting and he's in a dangerous condition for your tenant, you can immediately raise a claim in the tribunal to get this matter rectified quickly so you can avoid any potential liability claims raised by the tenant. You have done everything correctly by your explanation. Unfortunately, strata has not attended to this matter correctly. You can now raise proceedings in the tribunal. You’re handling this matter very well.If there is anything else, big or small, that I can help you with today, please let me know?
Customer
Please give me a contact email/phone number for the tribunal so I can make the next step.
