Hi! My name is***** a solicitor in Australia, and I’m happy to help you.

You will be able to seek an early release of super as your husband will not be returning to Australia.

There are requirements which you will need to meet to claim your DASP.

Which you do.

Generally, you can claim a DASP if the following apply:

  • you accumulated superannuation while working in Australia on a temporary resident visa issued under the Migration Act 1958 (excluding Subclasses 405 and 410)
  • your visa has ceased to be in effect (for example, it has expired or been cancelled)
  • you have left Australia
  • you are not an Australian or New Zealand citizen, or a permanent resident of Australia.

Use this link to claim your super:

https://www.ato.gov.au/Individuals/Super/In-detail/Temporary-residents-and-super/Super-information-for-temporary-residents-departing-Australia/?page=4#How_to_claim_your_super

Have I answered your question? If any part of my response is unclear, please let me know. It’s my goal to deliver excellent service, so please let me know if there is anything more I can do. Thank you for using our site.

Customer
he was a permanent resident of australia. just not a citizen, hence why he was deported. that is where we are having trouble as they keep telling him he cant take it out. he has even had the uk immigration sent our Government/ ATO / Superannuation to clarify his situation

If your husband follows the steps noted above, he will be able to retrieve his superannuation.
Customer
we also dont know what super he has. I think it has all been moved over to the government scheme to stop the fee coming out. we cant get into the Mygov website superannuation bit to see what he still has there.
Customer
ok ill send him the link and see if he can do it his side as he has all the particulars over there
Customer
thank you
