Customer: Hi, I'm in Qld and subject to CSA assessments on income. I'm past preservation age for super and took out $100k last year to pay property settlement and my solicitors fees. CSA deemed this as income so I now owe $12k above my monthly payments. I'm hoping to have a significant payout from a TPD claim in the next 6mths. The payout can go into super or as a lump-sum payment. What is the best way to avoid CSA seizing a significant proportion of this payment as half will be spent on a house for my son and I and the rest will contribute to my future support. I'm nearly 60. Thanks, Clem.
JA: When was the last support payment made? How much is owed?
Customer: Support payments made monthly and currently owe $12k.
JA: Has the court issued a wage garnishment order?
Customer: Nothing has gone through the court. Purely CSA assessment.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: Don't think so

Hi! My name is***** a solicitor in Australia, and I’m happy to help you.

What I suggest you do is engage an accountant, to do a full financial assessment on your particular situation, and then present that to CSA, That will fix your situation with CSA.

Your next step is to engage your local accountant to help prepare the financial statement.

You’re handling this matter very well.

If there is anything else, big or small, that I can help you with today, please let me know?

Customer
OK, so this is a purely accounting and tax issue, not a legal issue?

That is correct, it is an accounting matter that you need to focus on.
Customer
OK, thank you.
