Customer: My friend (Vietnamese) works for meat processor.
JA: What state/territory is your friend in? It matters because laws vary by location.
Customer: victoria - she had a Super fund and has found her money (about $5000) has been Rolled over to a new fund. Then a second fund was started with same fund as first one. The newfound cannot help or find her or her rollover money. We have had long conversations with all including the workplace. I’ll stop there while you absorb this info.
JA: What steps has she taken so far?
Customer: She has worked with agent going to employer but only has a doc to fill out to roll back money.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I help with language and phone calls to both the Super companies. The first say she actioned a rollover. She say no! There has been no letters of confirmation or follow up.

Hi! My name is***** a solicitor in Australia, and I’m happy to help you.

If the Superfund money has been rolled over without your friends approval, your friend will be able to make a claim against the Superfund through the local tribunal.

I suggest that your friend try and communicate with the Superfund amicably in writing first before commencing tribunal proceedings.

The State Tribunal is perfect for mediating disputes.

The document you file in the tribunal is the points of claim. You can download this from the tribunal website.

Draft the complaint in numbered order detailing the issue. I suggest that you also say what action you have taken to try and rectify the matter.

You can run your case yourself.

There are help menus on the tribunal website that you can use to assist you with the application and process.

When you lodge your application, you will receive an email from the tribunal with the next steps to follow.

I thank you for raising your question on Just Answer.

If there is anything else, big or small, that I can help you with today, please let me know.

But she cannot roll back because that fund has no record of the transfer - not her name or money.

I suggest that you commence proceedings of subpoena all information from the Superfund so you can determine exactly what's going on.
Customer
No call so far - now I’m worried I signed up for a fee on my card to get the call so I guess it will cancel?

We went back to both Companies and RestSuper is looking to undertake an Investigation.
We got a number from Amist but it was not the right account. However they are looking further to trace the $5036.77 that is still missing.
Thankyou for your interest and guidance
