John Melis, Expert

Hi, I’m John Melis, solicitor, and I am in Australia.

I can hear your concern and your voice, and if you follow the steps I’ve suggested, it will give you a direction moving forward.

The standing down of the employees would be classified as bullying conduct where there's no justified reason when an incident report is given.

The employees could raise a claim with the fair work commission. The employees may use the general protections provisions form on the fair work commission's website.

Please let me know how you go with this situation and the employer.

I can hear your concern and your voice, and if you follow the steps I’ve suggested above, it will give you a direction to go.

Please let me know if you have any more questions.

Thank you so much for your advice. The three employees have submitted the recommended form to FWC. The 3 employees have also been notified the Stood down has ceased and can return to work Monday. However the employees will be submitting a formal complaint to the State HR Manager on Monday.
