John Melis, Expert

Hi, I’m John Melis, solicitor, and I am in Australia.

I can hear your concern and your voice, and if you follow the steps I’ve suggested, it will give you a direction moving forward.

Has your friend considered legal aid st the moment?

Customer
he has - but the number he called said they'd meet him on the day. he wanted to discuss strategy before that
Customer
can't really afford 85 bucks right now, sorry

Customer
ok thanks John. Basically the situation is as follows. There was an argument and my friend apparently threw a pot plant. He didn't throw it at the bloke, he just threw it (he wasn't even looking at him apparently). Originally the plaintiff said he was hit with a baseball bat (he wasn't) but now seems to have change the story to he was hit by this pot plant. He has a scratch on his arm he claims is the injury
Customer
on the one hand, my friend is thinking it might be easier to plead guilty (he admits he threw the pot plant). But as he didn't intend to hit him with it, it seems a bit unfair.
he is nervous about going with a not guilty plea because he did throw the pot plant... The only witnesses were family of the lad that claims he was injured
Customer
this happend during and argument with my friends partner (the lads mother - he's an adult though). She called the police, he got a DVO and left - I and some others helped him move out the next day before midday, but this new charge seems to be an attempt to make his life harder

What outcome would you like to achieve?
Customer
he's already waiting an insurance payour for head and back injuries received in a workplace accident and really doesn't need the additional stress.
Customer
really, he needs advice on whether to plead guilty or not guilty. Hence not wanting to make the decision on the court date.
Customer
I assume the first hearing is just to hear pleas? OR will they have already sat a jury and run straight into it if he goes not guilty?

The first hearing will be to set the position for the next stage. So basically a summary moving forward.
Customer
85 bucks was too much, but for 8 - give him a call. The number on file is his not mine so you'll get straight through. Thanks John
