He was riding on the footpath and claims to have run into sand (placed on our block by the demolition company,while a house was being demolished. Photos taken at the time by the claimant's srep father show the footpath 1/4 covered and no wheel tracks in the sand We had no public liabilty insurance, as we assumed the demolition cmpany's insurance would be in place for any incident. They deny any liablilty and the claimant's lawyer ( a no-win, no-fee) outfit have been threatening action against us for an unspecified sum for unspecified damages. We have not engaged a lawyer to represent us to date, have been advised not to do so, by a professional lawyer. JA: What state is the stepfather in? It matters because laws vary by location. Customer: He's in QLD as are we and the claimant JA: What steps has he taken so far? Customer: the child's mother has engaged a lawyer who has presented us with an accident report from the staff who saw him at the Sunshine Coast Uni Hospital JA: Anything else you want the Lawyer to know before I connect you? You are liable if there was no warning sign or something to show that the sand was there.

Because it was placed there by the company they are the ultimate responsible party and that should be in the contract you have with them.

Your building insurance/contents insurance should have Public Liability up to 10Miliion built in.

The building company should cover the claim and you should join them.
