Customer: Hey there. So back in august. Centerlink told me i had to start a parent next program. In starting that program. I was told i should of been reporting my income. I was never told and have no record that i had to report for the past 5 yrs. So i rang to fix this up. In doing so i was told i owe centerlink $15000. For over payments. And they cut my payments of straight away. I asked for a review, that resulted in another $5000 being added to the total. I was told i had under estimated my husband income for the pasy 3 yrs. Which i had been updating as i knew the new amounts. They picked up on over paying child care last year, so we were already on a payment plan for $2600 , For over payment. My husband does his take return every year and we always update the amount. I asked for it to be reviewed again. To have a gentleman ring me really rudely asking why is looking into it. I said i cant work out how on earth we own them $20000. I updated my estimates, we does our tax return each year, so they get the updates from that and also we do our child support with CSA so they know how much of that we get back. The guy came back and said the Ato were slow in sending centrelink a copy of my husband tax return and thats how is resulted in overpayments. I havent received a cent from centrelink now since august. We are generally struggleing to break even each week, little to try and pay back that ,money. My kids used to play sports, we can no longer afford to send then to anything.

John Melis, Expert

Hi, I’m John Melis, solicitor, and I am in Australia. I want to thank you for taking the time to speak with me today. Your question means a lot to me. If I were in your position, I would feel just as you do. I’m so glad you contacted us about your situation. I will give you a direction to consider moving forward. I know you’ve spent a lot of time on this already. Your patience here has been so important. If I understand you correctly I suggest the following:

You can ask the AAT to review a decision. You should do this within 13 weeks from the date of the Authorised Review Officer's decision. You can still request a review after 13 weeks. However, if the AAT changes the decision, you may only get your entitlement from the date of the review.

Please use the above link, as this will provide you with all the necessary information to raise a case in the tribunal in respect to review of the Centrelink matter.

I know it isn't easy to deal with issues like this, but you're handling it so well.

I can hear your concern and your voice, and if you follow the steps I've suggested above, it will give you a direction to go.

I know you have a lot of choices, and there are various ways to move forward.

If there is anything else, big or small, that I can help you with today, please let me know?

I am so glad you contacted us, and I thank you for reaching out today.
