My neighbour pulled down my fence and my side garden to build on the boundary for a new house. When finished he did not

Expert's Assistant chat
Customer: My neighbour pulled down my fence and my side garden to build on the boundary for a new house. When finished he did not put the fence back on original line. He put the double sided fence all inside my boundary taking up part of my garden. He refused mediation and didn’t consult me over the fence. I’m a pensioner and 78 yrs old . What can I do?
JA: What steps have you taken so far? Have you prepared or filed any paperwork?
Customer: Yes . I have sent fencing order and he returned it, and said he was leaving it as is. Fencing disputes contacted him for mediation but he refused. They told me to go to legal aid . I contacted them but they don’t do fencing.
JA: Where is the house located?
Customer: My house*****Essendon Nth. The new house is *****Essendon Nth 3041. There were two houses built on the block. The owner’s house is*****Essendon Nth. 3041. The fence line on Bulla Rd is perfect with the boundary of 29 next door.
JA: Anything else you want the Lawyer to know before I connect you?
Customer: I let the owner use all my water for the build.Stored timber in my garage and bags of cement on my porch which have bleached the tiles. He gave me a Work protection order before he started to build.

Thank you for reaching out today. I appreciate your matter is urgent. My name is***** solicitor, and I am in Australia. You will be able to resolve this issue. I suggest as a first attempt that you try mediation. You can do mediation without the assistance of a lawyer. If you still can't get the matter resolved by communication, then engage a lawyer to help you communicate on your behalf.

I want to thank you for taking the time to speak with me today.
