Expert's Assistant chat
Customer: Hello I am my mothers carer. My brother was caught with a large amount of ice and was looking at 15 years jail. He escaped this by taking over carer of my mum. Mum has dementia and my younger brother whom has always lived with mum has paranoid scytzophrenia. As son as Peter got in as carer tried to get guardianship of mum and power of attorney. Due to him being the only one of 7children that has stolen from all even mum . My older brother michael now has guardianship and power of attorney.
Peter was carer for mum for 3/4 months but during this time was beating Shane the youngest 48yrs but has mental health issues but is not violent was beaten by Peter regularly. I have a voicemail from mum while it is going in because i had called in that day peter carried on and I left. Bashing Shane Mumm saying leave him alone and peter Saying everytime ii se her ..meaning myself Im Gunna flog him. I just gave it to him. Etc.
Shane made a statement as already was a DVO in place and 2/3 time neighbours had to intervene and save Shane.
So I came back as mums carer.
Peter has had sentencing adjourned twice and again for another 6 weeks . He has had my mum over at his house...she hasn't slept because he has been at her all night to get me out as he needs to to avoid jail as he did with the drug charges was probation and paroled due to being mums carer. He has to get back in here to be her carer and get me out of the picture.
She has dementia and Alzheimer's and he has. Manipulated her kept her up all night hounding her to put a DVO on me and get me out of the home that Shane lives in with mum the one he is facing sentencing for assault.
He was at our home last week and stole some of my things . I got police...they no help as mum has dementia and I wasn't home but made report to Crimestoppers wen noticed my swag home. I don't know wat to do as mum is scared of him and hasn't slept . He has worn her down and is at the police station trying to get a DVO.
Please help as he is a bad person and my mum really is scared of him. He stands over her and bashes Shane ...her baby lol
Please I'm not sure if my brother whom is guardian can nip this in the but
JA: What's the full extent of the incapacity? Have there been any expert medical opinions?
Customer: Yes. There has been specialist opinion. She is pretty bad. Dementia and Alzheimer's and will tell you he didn't hit Shane. The neighbours who got mum out of the house said Shane was curled up in a ball and he was still stomping on him and stuff. They said it was savage and thought he was going to kill him. Shane had had a community ordered injection the day before which renders him defenceless.
JA: Was an advanced directive or living will signed before the incapacity?
Customer: Mums neighbour would here him ranting at mum at midnight about how bad I am and wat I am telling her lies as I'm the only one whom will stand up to him for mum and for shane
JA: Anything else you want the Lawyer to know before I connect you?
Customer: The neighbour told me m was scared of him. He took her home with him yesterday after having his last adjournment for assault while on probation for six weeks the day before. She was so tired wen I spoke to her this morning
