Expert's Assistant chat
Customer: Hi, we found a "foster parent" for our family dog while we go through some changes. The dog will remain in my name while this lovely lady is happy to keep him at her house and look after him for as long as we need. What do I have to do to lay off my legal responsibilities for the dog while she's looking after him? For example if he jumps on someone when she takes him at the park? She may end up keeping the dog forever; I just don't know at this stage. Should I write on a piece of paper that from such and such day this person is the guardian of the dog and both sign it? Would that work to make her legally responsible for anything the dog may do while in her care? Kind Regards, Chiara
JA: What state are you in? Guardianship law varies by location.
Customer: New South Wales
JA: Do the biological parents consent to the guardianship?
Customer: He's a dog
JA: Anything else you want the Lawyer to know before I connect you?
Customer: Not for now, thanks

What you can do when you're important situation is just write a very simple contract between the parties confirming what you're doing. This is the safest way for you and the dog.

Can I write the contract myself? Does it need to be certified by a third party?
Customer
Can it just be an A4 piece of paper saying that from this date this lady is taking responsibility for the dog, signed by both parties?

Yes you can write the little agreement yourself, just state the facts as it what it is, and then you'll be okay. If you'd like to you can upload it to the chat box and I'll have a look for you as well. And then agreement should be signed by both parties.

Customer
Thank you so much. I will write it and upload it for you to review. Can I do so tomorrow? Cheers, Chiara
