Customer: I want to get in contact with someone who I do not have any contact details for. They had rung up about me. They have left their previous workplace last year 2019. One of the main reasons would be to invite to mediation. I would obtain someone experienced in mediation if possible. I rang law access a while ago and they said my only real option is by a private investigator. I rang a few of them. One of them suggested that I obtain a letter from a lawyer that simply supports the private investigator to do that. I would be interested in professional and private contact details or whatever is deemed most suitable. I guess it might also be best for the mediator to contact that person ? I am not sure if a mediator can provide a letter and organise it all themselves ? Anyway this is my first time to chat. (I am currently a low or very low income earner). I look forward to your advise. K

Customer: just what I said thats all .... I have rung some lawyers and I have been seeking mediators... I have one who will ring back (currently away) 29 July 2020 I believe

Customer: I am not sure to be honest... just taking one step at a time for the moment.....if it is possible then great... if not then i guess another time there may be another way ....

The New South Wales Civil Administrative Tribunal “NCAT” process is very good to meditate disputes of this type as it forces the parties to come together to discuss the issues involved.

However, before raising a claiming in NCAT, you should file for mediation at Fair Trading, and if the matter does not settle at Fair Trading, then obtain a certificate that mediation failed, and commence an action at NCAT.

In most cases at mediation the matter will settle.

The matter is Civil.

You will be the applicant and the insurer the respondent.

The important filing document is the points of claim. This document needs to be carefully drafted. 

I recommend that you download the application first, complete the same and then upload as required to commence the claim.

The alternative to this is filing an application in the local court, in which case you will be able to recover your legal fees as well in pursuit of the debt amount.

What you need to do is to write the complaint in a chronological order detailing what is the issue and what action you have taken to try and rectify the matter.

The chronological order need to be numbered with points 1, 2, 3, etc. with each point being a separate item. 

I recommend that you download the application first, complete the same and then upload as required to commence the claim.

This link above will assist you in the requirements to complete the application form and there are various help menus on the website that will also assist you in finalising the application that can be submitted in respect of pursuit of your claim.

Before you submit your application, make sure that you have all your evidence in hand as this will be required at the hearing date and to be served on the other party.

Keep in mind that once you have lodged your application you need to serve the application on the other party once instructed by the tribunal.

I am so sorry I think it would be very valuable to talk with you but at this stage its not easy for me to afford that so I might see if I can try and chat a bit but if you think it is too difficult to explain to me or similar by chat then maybe I can look into the phonecall. Is the process right to try and obtain a letter from a lawyer ? Can a mediator do that ?

What you can do is go to your local conveyancer or lawyer and they will be able to do a person search and get those details directly

What do I say to the conveyancer or lawyer ? What data do they use to do the search ? What happens if the individual is not a property owner ? Its lawful for me to do that ? just want to try and do the right thing thats all

Lawyers have access to search facilities which they pay annual fees for that allows and to search individuals locations in this particular respect.

sorry for slight delay...so it will work regardless of whether the individual is a property owner or not ? Is it any lawyer ? or should I look for a particular lawyer ? I know you also mentioned conveyancer Also what is typically the charge but I can find that our from them ? Ive been ringing some but only one will ring me back apparently on the 19 july (currently away) the others I have rung do not suggest or seem to think they can help me ?
