Customer: SORRY, I MEANT TO KEEP TELLING THE STORY, NOT UNDERSTANDING HOW THIS ON LINE CHAT WORKS, I BUILT SHELTERS ON SEVERAL PROPERTIES, WHERE I COULD KEEP THE DOGS, BUT NATURALLY THEY TRIED TO COME HOME.THE SHIRE CHARGED $200 INFRINGEMENT NOTICES, EACH TIME THE DOGS MANAGED TO GET OUT, THE PROPERTIES WERE ONLY TWO OR THREE BLOCKS AWAY FROM WHERE WE LIVE. THE DOGS AFTER ABOUT SIX MONTHS BEGAN TO SETTLE DOWN. THEN I RECEIVED A LETTER FROM THE SHIRE TO SAY "IF I RECEIVE MORE THAN TWO INFRINGEMENT NOTICES, THEN THE SHIRE HAS THE RIGHT TO CANCEL THE LICENCES OF EACH DOG, THEN IN 28 DAYS THEY CAN COLLECT THE DOGS AND DESTROY THEM IF THEY WISH.THE SHIRE EXPLAINED I HAD THE RIGHT TO APPEAL TO THE STATE ANMINISTRATIVE TRIBUNAL, WHICH I DID AND THAT WENT ON FOR SOME TEN MONTHS WITH LITTLE RESULT. THEN THE SHIRE PRESIDENT ASKED ME TO COME IN FOR A MEETING AS HE BELIEVES THE MATTER COULD BE SOLVED.HE ASKED ME IF I WOULD CALL OFF THE "S A T" BECAUSE IT WAS COSTING THE SHIRE TOO MUCH AND IN RETURN HE WOULD SEE THAT THE SHIRE LIFTED THE BAN ON THE DOG LICENCES. --- SO I FOLLOWED HIS INSTRUCTIONS.THEN I HEARD THAT HE WAS NOT ABLE TO BE PRESENT AT THE SHIRE MEETING AND HIS VOTE WAS NECESSARY. SO NOW I AM TOLD I HAVE BEEN OUTVOTED AND I MUST APPLY AGAIN TO "S A T" OR THE DOGS AGAIN CAN BE CONFISCATED AND DESTROYED.WE HAVE DISCUSSED THE BUILDING OF KENNELS IN THE INDUSTRIAL AREA, BUT I AM ELDERLY AND NOT PREPARED TO BUY ANOTHER BLOCK AND START ALL OVER AGAIN, KNOWING THEY CAN REZONE THAT BLOCK TOO IF THEY WISH. I HAVE LOOKED AT RENTING A BLOCK AND BUILDING KENNELS, TO BE ABLE TO KEEP THE DOGS AND STAY IN BUSINESS, HOWEVER THE SPECIFICATION FOR KENNELS STIPULATE THE OWNER MUST RESIDE AT THE KENNEL OR CLOSE, AND THE PROPERTY IS MORE THAN THREE MILES AWAY. I AM WORKING FOR ABOUT 6 HOURS A DAY AND I ESTIMATE THE DOGS WILL BE LEFT UN ATTENDED EVERY NIGHT AND SIX HOURS DURING THE DAY WHILE I WORKED, THIS WOULD MEAN THEY WOULD BE UNATTENDED FOR AT LEAST 20 HOURS EACH DAY. I HAVE A LETTER THAT STATES I WAS GIVEN PERMISSION TO BREED FROM SIX DOGS IN 1991 AND I BELIEVE BECAUSE I HAD PERMISSION TO BREED BEFOR THE LAND WAS REZONED, THEN UNDER THE TERM "NON COMPLYING USE"I COULD CONTINUE THIS LINE OF WORK UNTIL EITHER WE SOLD THE LAND, OR I GAVE UP BREEDING.HOWEVER, WHEN THE SHIRE CONFISCATED MY DOGS, THEY SAID IT WAS FOR THREE REASONS. ONE THERE HAD BEEN FOUR WRITTEN COMPLAINTS, TWO REGARDING NOISE, AND TWO BECAUSE PEOPLE HAD SEEN MY DOGS OUTSIDE OUR PROPERTY. I HAVE TENDED TO BOTH THOSE ISSUES. THE SHIRE ALSO TOOK SEVERAL DOGS BECAUSE ORIGINALLY I HAD PERMISSION FOR SIX AND I HAD KEPT SEVERAL OLD DOGS THAT WERE NO LONGER ABLE TO BE USED FOR BREEDING, BUT TOO OLD TO REHOME. THE SHIRE KNEW I HAD THOSE EXTRA DOGS, FOR AT LEAST 20 YEARS, BUT NEVER BOTHERED ABOUT MY KEEPING A FEW OLDIES.I RENT PROPERTY IN TOWN AND POINTED OUT TWO COULD BE LICENCED TO THAT ADDRESS. I ALSO POINTED OUT THAT THE DOG ACT PERMITS TWO DOGS TO EACH DWELLING ON THE PROPERTY AS LONG AS THE PERSON WHO RESIDES IN EACH DWELLING DOES NOT RESIDE AT THE MAIN HOUSE --- WE HAVE FIVE ACRES WITH THREE DWELLINGS. THE SHIRE ALSO POINTED OUT THAT WHEN I WAS GIVEN PERMISSION TO KEEP SIX DOGS AND BREED IN 1991, THEN THAT WAS ONLY FOUR THOSE DOGS, WHO NOW HAVE DIED, SO MY PERMISSION HAS EXPIRED, YET FOR THE LAST 30 YEARS OR MORE I HAVE PAID THE LICENCES FOR EACH DOG AND AS THE DOGS DIED THEY JUST CHANGED THE NAMES FOR THE PAPERWORK.

Customer: SSORRY, I KEEP PRESSING THE INDENT BUTTON AND IT SENDS OFF MY WORK BEFORE I AM FINISHED.I HAVE EXPLAINED TO THE SHIRE THAT IF MY PERMISSION TO BREED HAD EXPIRED, THEN I SHOULD HAVE BEEN NOTIFIED AND THEY SHOULD NOT HAVE ACCEPTED THE MONEY, UNLESS I REAPPLIED. I AM OFF THE TRACK A BIT NOW, BUT CAN SOON CATCH UP. THE LAND IS IN CARNARVON. THE AREA IS CALLED "KINGSFORD" WE WERE ADVISED TO BUY THIS LAND AS WE WERE IN THE TOWN AREA ON A RESIDENTIAL BLOCK. THE SHIRE OPENED THIS LAND AS FARMLETS, AND I WANT TO BREED DOGS AND MY HUSBAND TRAINED RACEHORSES. WE WERE THE FIRST PEOPLE TO BUY IN THIS AREA, WE TOOK ON THE PROPERTY BEFOR THERE WAS EVEN WATER OR ELECTRICITY. WE BOUGHT THE LAND IN 1978 AND I APPLIED TO BREED WITHIN A YEAR OR TWO OF BUYING THE PROPERTY, HOWEVER THE SHIRE CANNOT FIND RECORD OF WHEN I FIRST APPLIED, THE ONLY RECORD WE HAVE IS FOR 1991. IN ACTUAL FACT I HAVE BEEN BREEDING FOR SOME 40 YEARS, AND HAVE ALWAYS BEEN A REGISTERED BREEDER.I RECENTLY CHANGED FROM BEING REGISTERED WITH THE CANINE ASSOCIATION, TO JOINING THE MASTER DOG BREEDERS AND ASSOCIATES. WITH MDBA WE ARE PERMITTED TO BREED FROM ANY DOG WHO IS CLASSED HEALTHY. THE CANINE ASSOCIATION WILL NOT PERMIT US TO BREED ONCE A DOG HAS TURNED 5 YRS --- THEY SOMETIMES LIVE 15YRS, SO AT 5, THEY ARE ALMOST STILL PUPS. THE MDBA BELIEVE, PREVENTING A DOG FROM HAVING PUPS WILL CAUSE EARLY MENAPAUSE AND THIS IN TURN CAN COUSE BONE DEGENERATION PROBLEMS.I AM A BIT OFF TRACK NOW, PLEASE CAN YOU TELL ME IF YOU THINK I HAVE A CASE.

I USE A DOG TRAILER AND THERE HAVE BEEN TIMES WHEN THEY WILL DRIVE ONTO OUR LAND AND COUNT HOW MANY DOGS ARE IN THE TRAILER AND BECAUSE THE TRAILER IS PARKED ON OUR LAND THEN I AM GIVEN INFRINGEMENT NOTICES BECAUSE I HAVE MORE THAN TWO DOGS ON THE PROPERTY, EVEN THOUGH I MAY HAVE STOPPED ONLY FOR A MATTER OF MINUTES. THEY FOLLOW ME TO THE BUSH OR THE BEACH LATE AT NIGHT, THEN FINE ME IF ANY DOG IS NOT ON A LEAD, EVEN THOUGH I GO RIGHT AWAY FROM THE TOWN AREA AND IT IS OFTEN AFTER SEVEN AT NIGHT.
