Expert's Assistant chat
Customer: Hello, I went through the family law court in Alice Springs NT ans was granted sole parental right of my 1 daughter. We have since relocated to Newcastle NSW and have lived here for 2 years. it has been 2.5 years since the father has seen or contact the child but has sent a text message asking to reconnect.
JA: What steps have you taken? Have you filed any papers in New South Wales family court?
Customer: I have not filed any paperwork or done anything yet as I dont yet trust that his request is genuine and that he will follow through with it
JA: Have you talked to a lawyer about this yet?
Customer: no not yet, I dont want to block any contact between them, but i also dont want to again pay thousands of dollars in legal fees and be dragged through all that abuse again. Can he start proceedings with Family court in the NT?
JA: Anything else you want the Lawyer to know before I connect you?
Customer: We were in the courts for about 3 years and the breakdown of the relationship was very violent, resulting in a DVO against him. I am very fearful that he may take her and not return her if i agree to visitation

Hi John. I just want to know if the father can have supervised visits without having to sign over my sole parental rights. And can he start the proceedings himself in Alice Springs?

We went through the family court in Alice Springs NT where i was granted sole parental rights to my daughter. We then relocated to another state.
It has now been 2.5 years since the father has contacted or seen the child. He has sent me a text message asking to rebuild a relationship with the child. He asked if she could spend the day with him whist he was visiting the city for a holiday. I am uncomfortable with this it has been too long and i dont trust that i will get her back again.
What i am asking is can the father arrange with the family court in Alice Springs to start reconnecting with the child. I want to remain the sole parent i dont want to pay thousands of dollars in legal fees (again) and i dont want to communicate with the father directly. And obviously i have no plan on moving back to the NT.
How will it all work with them being in separate states?

The bot***** *****ne to your particular situation is that being in two separate states will create enormous complications and costs to both parties that it actually will not work to the benefit of the best interest of the childrenIn the current circumstance one party will sacrifice their circumstances with the childrenThe best situation with this he is to have some form of mutual agreement between the parents in regards ***** ***** for spending time with the children and amicable basis
Customer
I am happy to make an agreement with the father but i want it done through the right legal channels so that i am covered if he does take her or get violent or abusive again.

The best way to do this agreement is through your lawyer and with his lawyer that way it’s gonna be efficient, precise, and best interest of the child and both parties
