Customer: iF a leak thtrough the sealant of the frame of a window in a block of units damages the carpets is that a matter for the body corporate
JA: What steps have been taken so far? Has any paperwork been prepared or filed?
Customer: Lifted the carpet removed the underlay and managed to get some sealant into the gap created when the original sealant fell out . Which is incidentally on the outside of the building
JA: The Real Estate Lawyer will be able to walk you through that. Where is the property located?
Customer: unit 20 720 Old Princes Highway Sutherland 2232
JA: Anything else you want the Lawyer to know before I connect you?
Customer: The strata manager says it is not a body corporate matter even though the rain has entered through a fault in the building and as it is on the out side of the building we had no way of knowing that we were at risk

Are you an owner or tenant in this apartment complex?

Thank you for your clarification, if the leak has been caused by window as a result of inappropriate sealant or poor sealant, and that window is a body corporate window, then the owner of the apartment, you were your carpet is damaged, will be able to raise a claim against the body corporate. But if the leak is a result of a window that is owned by the owner as part of the unit complex itself, then the damage to the carpet is one unfortunately is that of the owners to repair through their insurance..

If the leak is that of another owners unit which has caused damage to your unit then the other owner is liable..
