Customer: I have been renting my house out to my daughter in law and have recently moved back to SA and now living in a caravan on my property. There is a separate space detached from the house with toilet, laundry, bathroom and recently when I went to wash I noticed ants everywhere so I started trying to clean up to find the source as they can cause major damage to the wiring if left unattended. She told me she had put a box of stuff of mine on top of the fridge from before I left. She helped me get it down and it was full of ants from food that had been left in the box .I clean it out and proceeded to clean up the area and spray the ants that were all through the laundry. She then told me to stop going through her stuff when I told her I was not going through her stuff but I must get rid of the ants before they do major damage and I am happy to help her go through everything and pack it properly so we don't have a problem. She then said ;;I asked you nicely" unfortunately I then snapped at her and told her as she had flatly refused to pay a rent increase after living here 16 months and has not maintained the garden, lawns or gravel as agreed upon in return for cheap rent, my home has now been decreased in value by a significant sum of money that I now have to re-establish and if she clearly hasn't been meeting the agreement we made then she should find somewhere else to live. we are in fire danger season and I live in the Adelaide hills I have also been trying to clean up the yard as it is now a full on fire hazard through not being maintained both the lawn areas are dead and I have dead paddock grass thigh high through out the whole garden area that I have literally been slashing by hand as it is too high to mow . Even though I have apologies for snapping at her and explained the financial situation I have only been home two weeks so I am unemployed at this stage. I am not on any benefits I am paying the required mortgage repayment of $500 a month on top off the rent I am receiving which is now coming out of the small amount of principle I have payed. This has now escalated to her blantantly lying to my son and she has told me I have 24 hours to get of the premises else she'll call the cops. I asked her if it is possible to finished cleaning up the yard before I leave as it is dangerous to leave it like it is and have not had a response back. this will in fact leave me homeless as I cannot afford to rent else where and meet my mortgage payments at this time.
JA: Because laws vary from place to place, can you tell me what state the property is in?
Customer: SA
JA: What are the terms of the lease? Any issues related to maintenance or upkeep?
Customer: I signed a basic rental agreement that she needed to get rent assistance from centerlink. I charged no bond but she said told me last night she had bond in trust from the last rental she was in and that she had sent me a copy of the rental agreement which I did not receive. I have been literally working every day to clean up the yard ,as it is a fire danger and all my lawn areas are dead at the back of the yard paddock grass is thigh high which was non excistant when I left here ther are piles of rubbish every where and I have had to clean all the shed out and pack everything safely as it was just all piled up with debree
JA: Anything else you want the Lawyer to know before I connect you?
Customer: apparently as she emailed me last night the tenancy agreement that I signed because she has now sent me the other pages of the agreement which I hadn't seen when I signed what I thought was the document for rent assistance for centerlink I did not put anything in writing and had a verbal agreement about what was expected to be maintained on the property which I had dropped the rent by $70 to what I had previously been getting in 2017 to cover any cost to maintain the premises how it was when I left it. which has not been respected.
